The consent of Dublin City Council is required in certain circumstances for the:
- Sale
- Transfer
- Re-mortgage
- Sale or transfer of a plot
of some of the Dublin City Council houses sold to former tenants.
How do I apply for consent?
Applications can made through your solicitor in writing to include the following information:
To apply for consent to sell a property:
- The seller and buyer must complete application forms 1/S and 2/S (note: additional information may be required)
To apply for consent to transfer the property to a family member or relation:
- you must submit a letter outlining the change
To apply for consent to re-mortgage the property:
- you must submit details of the:
- name of Lending Institution
- amount of loan
- the reason for the re-mortgage
To apply for consent to sell a plot of land formally owned by a local authority:
- you must submit details of the:
- price
- the name and address of the buyer
- the reason for transfer
- a map
There is a €50 application fee (note: this should only be submitted when asked for in writing by the Consents Section).

What conditions must be met before Dublin City Council grants consent?
- The vendor/seller of the property and his/her dependents must have suitable permanent alternative accommodation
- If the vendor is going to live in a property owned by family members etc. then forms 1/S(a) and Right of residence must be completed.
- The purchaser/buyer must be in need of housing
What is the Fee Simple/Ground Rent?
The Fee Simple/Ground Rent buy out application process relates to the fact that, before 1978, houses were permitted to be sold although the ground they were built upon still remained in the ownership of Dublin City Council. Since 1978 houses cannot be sold unless the ground they are built upon is sold with them.
