Under Part V of the Planning and Development Act 2000 - 2021 the applicant/developer, where applicable, must enter into an agreement with the Local Authority to deliver 20% social/affordable housing. The options to comply with Part V are:

  • Transfer of Land
  • Transfer of Houses on site
  • Transfer of Houses off site
  • Leasing of Houses on or off site
  • Combination of both, including the transfer of on-site land

Exemptions:

  • Provision of houses by an approved housing body (AHBs) – AHBs must be mentioned on the planning application
  • Development of houses under a Part V agreement
  • Conversion of an existing building – 50% of exterior retained
  • Carrying out of works on existing house

No Exemption Certificate required for the above

  • 4 or fewer houses
  • Sites of 0.1 ha or less

Developer/Applicant Requirements:

Part V Costings Pack and Part V Checklist – If Part V applies, both the Costings Pack and Checklist must be submitted to the Part V team prior to commencing on site, along with the proposed land values (both the Existing Use Value and Development Value).

Failure to submit all required documents will result in the application not being assessed by the QS division.
