Information on Exports to Non-OECD Countries
Article 36 of the Waste Shipment Regulation (WSR) lists the waste types that are prohibited for export to non-OECD countries. It covers all hazardous wastes and a number of mixed wastes. Article 34 further states that all exports for disposal to non-OECD countries are prohibited.
Shipments of green list waste for recovery are potentially permitted to non-OECD countries in accordance with Article 37 of the WSR. The European Commission sent a questionnaire to all non-OECD countries seeking confirmation of what the procedure of export to these countries should be i.e. a prohibition, shipment under prior written notification and consent or shipment as a green list waste. If a country did not issue a reply, the shipment must take place under the procedure of prior written notification and consent.

It is the responsibility of the exporter/notifier to familiarise themselves with the controls that the proposed destination country imposes on the type of green list waste being exported.
